Terms of Service
Terms governing your use of Home 3D Plan, including acceptable use, intellectual property, and limitation of liability.
These Terms of Service (the "Terms") are a binding agreement between you ("you") and the operator of Home 3D Plan ("we", "us", "our"). They govern your access to and use of the Home 3D Plan website at home3dplan.com, its progressive web app, and all related tools and features (together, the "Service"). Please read them carefully.
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
1. Acceptance of these Terms
By creating an account, signing in, or otherwise accessing or using any part of the Service, you accept these Terms and agree to be bound by them, together with our Privacy Policy (available at /privacy) and our Cookies Policy (available at /cookies), each of which is incorporated into these Terms by reference.
You may use much of the Service, including the 2D floor-plan editor, the 3D editor, and the modelling tools, without an account. Some features, such as saving your projects to the cloud and the optional AI features, require you to sign in or to configure additional settings. Whichever parts of the Service you use, these Terms apply to that use.
If you do not agree with any part of these Terms, your only remedy is to stop using the Service.
2. Eligibility and minimum age
The Service is intended for general audiences and is not directed at young children. You must be at least 13 years old to use the Service. If the laws of your country set a higher minimum age for using online services or for consenting to the processing of personal data, you must meet that higher age.
If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Service, you represent that you meet these requirements and that you are legally capable of entering into a binding agreement with us.
3. Description of the Service
Home 3D Plan is a browser-based home design platform that runs in any modern web browser and can be installed as a progressive web app (PWA) for offline use. The Service includes tools to draw 2D floor plans to scale on a snapping grid, with doors and windows that snap into place; a 3D editor with a first-person walkthrough of the rooms you draw; a drag-and-drop furniture catalog containing thousands of pieces; and a one-click photo render that snapshots the lit 3D scene to an image (PNG).
The Service also includes live share links that let a viewer open a plan (read-only or editable) without creating an account; a separate SketchUp-style 3D modeller offering Push/Pull, Move, Rotate, Scale, and component tools with export to GLB and OBJ; a DraftCAD 2D CAD drafting tool that exports DXF, SVG, and PDF; AI plan recognition that imports a floor-plan image; and an optional AI design partner powered by Anthropic's Claude. The native project file format is ".hdp"; 3D models export to GLB and OBJ; and DraftCAD drawings export to DXF, SVG, and PDF.
Because the Service can be installed as a PWA, it may run offline and store your projects and edits locally in your browser, for example in your browser's local storage. You are responsible for your device and your browser storage. Data created offline, or created while you are not signed in, is not backed up to the cloud and may be lost if you clear your browser data, switch devices or browsers, or do not sign in to save your work. We are not responsible for the loss of locally stored or unsynced content, and we are not responsible for any conflicts that arise when local changes are later synced.
We are continually improving the Service and may add, change, or remove features at any time, as described in the section on Changes to the Service and to these Terms. The Service is a design and visualisation aid only. It does not provide engineering, architectural, structural, surveying, building-code, or other professional advice, and outputs such as measurements, dimensions, and parts lists are estimates that you must independently verify before relying on them for construction, purchasing, or any regulated purpose.
4. Accounts and account security
You can use the editor without an account. To save your projects to the cloud and to use certain features, you must sign in. Sign-in is provided exclusively through Google using Firebase Authentication. The email address associated with your account is managed by Google, and your use of Google sign-in is also subject to Google's own terms and policies.
You are responsible for maintaining the security of the Google account you use to sign in and for all activity that occurs under your Home 3D Plan account. You agree to notify us promptly of any unauthorised use of your account or any other breach of security that you become aware of.
You may delete your account and all associated data at any time from the Settings / Profile panel. Deletion is permanent and removes your saved projects and associated stored data from the Service. We describe how we handle your data, including any limited retention, in our Privacy Policy.
5. Plans, fees, and billing
The Service is currently provided completely free of charge. There is no paid tier and no watermark applied to your work.
We may introduce paid plans or paid features in the future. If we do, we will present the applicable fees and billing terms to you clearly before any charge is made, and we will not charge you for a paid feature without your prior agreement. If you choose to use a paid feature after the fees and billing terms have been presented, your continued use of that feature constitutes your acceptance of those fees and terms.
Nothing in these Terms obligates us to keep the Service free. We may change our pricing or introduce charges in the future, subject to presenting the applicable fees and billing terms before any charge, as described above and in the section on Changes to the Service and to these Terms. The optional AI features depend on your own third-party Anthropic account and any usage charges that Anthropic bills you directly, as described in the section on AI features below; those charges are separate from, and not controlled by, us.
6. Your content and ownership
You retain ownership of the designs, plans, models, projects, and any materials or textures you create or upload using the Service ("Your Content"). We do not claim ownership of Your Content.
To operate and provide the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display Your Content solely as necessary to provide the Service to you and the people you choose to share it with. For example, this licence allows us to store your saved projects so you can open them again and to render the live share links you create. Storing your projects is not a backup service. We do not guarantee that Your Content will be retained, available, or free from loss or corruption, and you are responsible for keeping your own copies, for example by exporting to .hdp, GLB, OBJ, or PDF. This licence exists only for as long as Your Content is on the Service and ends when you delete the relevant content or your account, except where limited retention is required for the purposes described in our Privacy Policy or by law.
You are solely responsible for Your Content. You represent and warrant that you own Your Content or otherwise have all rights necessary to upload it and to grant the licence above, and that Your Content does not infringe the rights of any third party or violate any law. You must not upload materials, textures, or other content that you do not have the right to use.
7. Acceptable use and prohibited conduct
You agree to use the Service lawfully and responsibly. You must not use the Service to upload, create, store, or share content that is unlawful, infringing, defamatory, harmful, or that violates the rights or privacy of others.
You must not: attempt to gain unauthorised access to the Service, other users' accounts, or our systems; interfere with or disrupt the integrity or performance of the Service; introduce malware or other harmful code; probe, scan, or test the vulnerability of the Service without our authorisation; or circumvent any access controls or usage limits.
You must not misuse the live share and collaboration features, for example by sharing links containing content you do not have the right to distribute or by using an editable share link to harass others. You must not use the Service or any of its outputs in a way that would cause us to breach our obligations to any third party, including Google or Anthropic.
8. Licence to use the Service and restrictions
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business design purposes.
You must not: resell, sublicense, rent, lease, or otherwise commercially exploit the Service itself; copy, modify, or create derivative works of the Service or its underlying software; reverse engineer, decompile, or disassemble any part of the Service, except to the extent that this restriction is prohibited by applicable law; or remove, obscure, or alter any proprietary notices.
You must not use automated means, such as bots, crawlers, or scrapers, to access, harvest, or copy any part of the Service or its content, including the furniture catalog, except as expressly permitted by us in writing. The licence in this section relates to the Service software and does not affect your ownership of Your Content, nor your rights in the files you export, such as PDF, GLB, OBJ, and .hdp files.
9. AI features and bring-your-own-key
The Service offers optional AI features, including AI plan recognition (which imports a floor-plan image) and an AI design partner. These features are powered by a third-party large language model, Anthropic's Claude. The AI features are entirely optional, and the Service is fully usable without them.
To use the AI features, you must supply your own Anthropic API key. When you provide a key, it is stored encrypted on our server, and only a boolean flag indicating whether a key is present ("hasAnthropicKey") is exposed to the browser; the key itself is never returned to the client. You are solely responsible for obtaining and maintaining your own Anthropic account and API key, for keeping that key confidential, and for any usage fees or other charges that Anthropic bills you directly for your use of the AI features. We do not control, and are not responsible for, Anthropic's pricing.
AI output is generated by a third-party model and is provided strictly "as is". It may be inaccurate, incomplete, outdated, unexpected, or unsuitable for your purposes, and it must not be relied upon as professional advice. You are responsible for reviewing and verifying any AI output before using it. Your use of the AI features is also subject to Anthropic's own terms and policies, and you agree to comply with them. We may add, change, suspend, or remove the AI features at any time.
10. Our intellectual property
The Service, including its software, design, user interface, text, graphics, logos, the furniture catalog, and all related intellectual property, is owned by us or our licensors and is protected by intellectual property and other laws. Except for the limited licence to use the Service granted in these Terms, no rights are transferred to you.
The names "Home 3D Plan", "DraftCAD", and our logos and other brand features are our property. You may not use them without our prior written permission, except to refer to the Service factually.
All rights not expressly granted to you in these Terms are reserved by us and our licensors.
11. Copyright and infringement notices
We respect the intellectual property rights of others and expect you to do the same. Because the Service lets users upload materials and textures, place catalog items, and publish content through live share links, we will respond to clear notices of alleged copyright or other intellectual property infringement.
If you believe that content available through the Service infringes your rights, please contact us at the legal contact email set out in the Contact section and provide: the URL or other identification of the allegedly infringing content; a description of the work or right you say has been infringed; your name and contact details; and a good-faith statement that the use is not authorised by you, the rights holder, or the law. Please provide enough information for us to locate the content and assess the claim.
We may remove or disable access to content that we reasonably believe to be infringing, and we may forward your notice to the user who provided the content. We may suspend or terminate the accounts of users who are repeat infringers. Submitting a knowingly false or bad-faith notice may expose you to liability, so please only submit a notice if you are confident in the claim.
12. Third-party services
The Service relies on third-party providers to function. We use Google for authentication and for Firebase hosting and storage (including Firestore, where saved projects and uploaded materials and textures are stored), and we use Anthropic to provide the optional AI model through your own API key.
Your use of these third-party services is subject to their own terms and privacy policies, which are outside our control. We are not responsible for the availability, accuracy, or practices of any third-party service, and any issues you have with a third party should be raised with that provider.
If a third-party provider changes, restricts, or discontinues a service we depend on, the corresponding features of the Service may be affected, and we will not be liable to you for any resulting unavailability.
13. Sharing and collaboration
The Service lets you create live share links so that others can open a plan (as a read-only viewer or as an editor) without an account. When you create a share link, you are responsible for who you share it with and for the content you make available through it. Anyone who has the link may be able to view, and where you grant edit access change, the shared plan, so treat share links as you would any publicly accessible link.
You can stop sharing by disabling or revoking a share link where the Service provides that option. You are responsible for ensuring you have the right to share Your Content and for any content that you or your collaborators contribute through the sharing features.
Contributions and other input submitted by editors and collaborators through a share link are the responsibility of the people who provide them. We do not endorse and are not responsible for content contributed by editors or collaborators, and we have no obligation to pre-screen, monitor, or moderate it. We may, but are not required to, remove content that we believe violates the acceptable use rules in these Terms or that is otherwise objectionable, at our discretion.
14. Privacy and data
We take your privacy seriously. Our Privacy Policy, available at /privacy, explains what personal data we collect, how we use it, and the choices available to you. Our Cookies Policy, available at /cookies, explains our use of cookies and similar technologies. By using the Service, you acknowledge these policies.
User data, including saved projects and uploaded materials and textures, is stored using Google Firebase and Firestore. Basic, anonymous analytics are collected only where you opt in through our cookie banner, and you can decline or withdraw that consent. We do not sell your personal data.
Where these Terms and the Privacy Policy address the same subject, the Privacy Policy governs the handling of your personal data.
15. Service availability and data
The Service is provided without any uptime, backup, or data-retention commitment, and this is especially the case while the Service is free. We do not guarantee that the Service will be continuously available or that Your Content, whether stored in the cloud or locally in your browser, will be backed up or protected against loss or corruption.
You are responsible for keeping your own copies of your work by exporting it, for example to .hdp, GLB, OBJ, or PDF. We strongly encourage you to export important projects regularly, particularly before changing devices or browsers, clearing browser data, or relying on a design for any real-world purpose.
We may perform maintenance, make changes, or experience downtime that interrupts access to the Service, and we are not liable for any resulting loss of access or data, subject to the disclaimers and limitations of liability below.
16. Feedback
If you choose to send us suggestions, ideas, feature requests, or other feedback about the Service ("Feedback"), you agree that we may use that Feedback freely and without restriction or obligation to you.
You grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, and incorporate your Feedback into the Service or any of our products, without any compensation or attribution to you. You are not required to provide Feedback, and we are not obliged to use it.
17. Compliance with laws and export controls
You are responsible for complying with all laws that apply to your use of the Service, including export-control and sanctions laws. This is particularly relevant because the optional AI features route requests through Anthropic, a United States provider, using your own API key.
You represent and warrant that you are not located in, and that you will not access or use the Service from, any country or territory that is subject to comprehensive government sanctions or embargoes, and that you are not identified on any government restricted-party, denied-persons, or similar list.
You agree to use the Service, including the AI features provided through Anthropic, in compliance with all applicable export-control, sanctions, and other laws, and not to export, re-export, or transfer the Service or its outputs in violation of those laws.
18. Termination and suspension
You may stop using the Service at any time, and you may delete your account and associated data from the Settings / Profile panel.
We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if we reasonably believe your use poses a risk to the Service or to others, if required by law, or if we discontinue the Service. Where it is reasonable and lawful to do so, we will try to give you advance notice.
Upon termination, your right to use the Service ends. Provisions of these Terms that by their nature should survive termination, including those on Your Content licences that remain necessary, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will survive. We are not liable to you or any third party for suspending or terminating access in accordance with these Terms, although we encourage you to export your projects, for example to .hdp, GLB, OBJ, or PDF, before you stop using the Service.
19. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, that defects will be corrected, that data will be backed up or preserved, or that any content, measurement, dimension, parts list, 3D model, photo render, or AI output will be accurate, complete, or suitable for your purposes. The Service is a visualisation and design aid and is not a substitute for professional architectural, engineering, structural, surveying, or building-code advice.
Any material you download or otherwise obtain through the Service, including exported files, is accessed at your own discretion and risk, and you are responsible for verifying it before use. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, and you may have additional rights under your local consumer law that these Terms do not override.
20. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
This includes, without limitation, losses arising from inaccurate measurements or parts lists, reliance on AI output, charges billed to you by Anthropic, the unavailability or interruption of the Service, the loss or corruption of Your Content (including locally stored or unsynced content), or the acts of third parties, including viewers who access your share links.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service and these Terms will not exceed the greater of the amount you have paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred United States dollars (USD 100). Because the Service is currently provided free of charge, this amount may be USD 100. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence; in those cases, our liability is limited only to the minimum extent permitted by law.
21. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to: your use or misuse of the Service; Your Content; your violation of these Terms or of any applicable law; your infringement of any third party's rights; or your use of the AI features, including any matter arising between you and Anthropic.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us. You will not settle any such matter affecting us without our prior written consent.
22. Changes to the Service and to these Terms
We may modify, suspend, or discontinue the Service, or any feature of it, at any time, including the editor, the modeller, DraftCAD, the photo render, the furniture catalog, the AI features, and the sharing features. Where reasonable, we will try to give notice of significant changes.
We may also update these Terms from time to time, for example to reflect new features, legal requirements, or changes to our practices, including the possible introduction of paid plans. When we make material changes, we will update the "last updated" date shown on this page and, where appropriate, provide additional notice.
Your continued use of the Service after updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may delete your account.
23. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them, the Service, or their subject matter are governed by the laws of [Jurisdiction], without regard to its conflict-of-laws principles.
You agree that the courts located in [Jurisdiction] will have jurisdiction to resolve any dispute arising out of or relating to these Terms or the Service, and you submit to the exclusive jurisdiction of those courts, except where applicable mandatory consumer-protection law gives you the right to bring proceedings in the courts of your place of residence.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the matter informally. Nothing in this section limits any non-waivable statutory rights you may have under the law of your country of residence.
24. Miscellaneous
These Terms, together with the Privacy Policy and the Cookies Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganisation, or sale of assets, without your consent. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. These Terms do not create any agency, partnership, or joint venture between you and us, and there are no third-party beneficiaries.
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, internet or telecommunications failures, power outages, governmental action, or failures or changes of third-party services such as those provided by Google or Anthropic (force majeure).
